<p>You have the right to demand information concerning your debt pursuant to legislation under the Fair Credit Reporting Act (FCRA), where these collection agencies have to follow certain guidelines and code of conduct.  Demanding information is your right as a citizen.  Protect yourself by sending it certified mail, return receipt requested.</p>
<p>Put the following information in your letter to LVNV Funding and demand answers: What is the total amount of the debt and what calculations did they use.  This will show additional fees or penalites as well as inflated amounts.  Proof the statute of limitations has not expired and contract where you agreed to pay the debt.  Also, where are they licensed and do they have the authority to collect in your state. </p>
<p>Send your letter all three credit reporting agencies as well, also certified mail with return receipt requested.  Tell them the collection agency is violating your rights by listing an inaccurate or erroneous account, and to correct or delete this entry on your credit report.  Ask that if the debt is deleted that they will not allow the collection agency to reapply for collection.</p>
<p>LVNV Funding will try to reapply the erroneous information to your credit report, even after having the judgment or debt removed legally by a court of law.  They will not stop. Protect yourself as much as you can from this agency.  One way is to check your credit report as often as you can.</p>

			<content:encoded><![CDATA[<p>Many collection agencies are filled with honest and professional people who sincerely want to provide assistance to help you pay a debt.  They will treat you and your situation with respect and concern.  Collection agencies are a fact of life, and it is stressful to constantly receive phone calls, certified letters and other stressful reminders that you owe somebody, somewhere, money. </p>
<p>Most collection agencies that we hear about the most, however, are those who badger consumers with phone calls, sometimes three or four times a day.  They may be computer generated with computer voiced instructions to return the call.  Some are live persons who will scream over the phone at the most sensitive, causing psychological harm.  They demand to know when payment is going to be made, without offering any assistance or payment plan. </p>
<p>Collection agencies are doing their job and do have the right to collect a debt you owe.  But as a consumer, you do have certain rights.  You are protected under legislation under the Fair Credit Reporting Act or FCRA.  This requires collection agencies to follow certain guidelines and code of conduct.  Regulations under the Fair Debt Collection Practices Act (FDCPA) prohibit collection agencies from speaking to your neighbors or contacting your employer to discuss collection of a debt.</p>
<p>While these laws do not protect you from the original creditor, it does create an atmosphere of civility.   If you owe the money, you have to pay it.  Unless you have filed personal bankruptcy, there are also statute of limitations considerations on the debt owed, so it is wise to take the steps of writing a letter to begin your process of what is referred to as &#8220;Debt Validation.&#8221;  </p>
<p>Debt Validation confirms that you are the original debtor and are responsible for payment of the debt.  Many collection agencies use scrupulous and illegal methods to collect.  In some cases, they have inflated the amount owed by tacking on fees, penalities and interest, all totaling to a massive markup.  This results in a large profit for them.  If your debt has been charged off or sold to another company, making money off your misery is how they do business.  Sometimes, the debt doesn&#8217;t even belong to you, and has been reported to the credit report companies in error. </p>
<p>You have the right to contract the collection agency and ask for the following information:  How much the debt is, what calculations they used to figure the amount (which will show the added on fees, penalties, etc) and proof the debt is yours by providing a copy of the contract you would have signed.  You can ask to see their license and under what authority they have to collect in your state.  Ask all these questions in a certified letter, return reciept requested. </p>
<p>As a consumer, you have the right to question whether this debt is truly yours or is an error. </p>
<p>Also write to the three credit agencies, informing them they are violating your rights as a consumer by not investigating inaccurate or erroneous information on yoru credit report.  Send this letter also by ceritified mail and return receipt requested to correct or delete this information.  Also ask that after the debt is deleted that it not allow the collection agency in question to reapply for collection.  Key questions and information should be confirmed by them. </p>
<p>Even after the debt has been removed by a Judge in a court of law, some collection agencies will attempt to reapply the debt to your credit report.  You as a consumer have rights and you should watch your credit report constantly to protect your financial health.</p>

<p>Many times the original debt is a minimal amount.  However, once the debt has been charged off your account can be sold to a collection agency. At this point, the purchaser of the debt can mark up the total amount in order to make a profit.  This often comes under the guise of fees, interest rates and penalties.  LVNV is one such collection agency whose business practices and collection process are questionable and who use derisive tactics for collection. </p>
